This is a website/blog registered in Brazil, where  the Psychologist Marcos Boson holds a professional license to offer telehealth services under registration CRP: 04/31971 with the National Psychology Council of Brazil, regional board of Belo Horizonte, State of Minas Gerais. Therefore, this website is authorized by local health regulations and operated by a licensed professional to provide health, psychological, or psychotherapeutic services to local and remote users.

The meeting (online) between Users and the Professional takes place via an encrypted video call system of which sessions are never recorded. When personal data collection is necessary, such data is processed in accordance with Regulation (EU) 2016/679 (GDPR), which governs and strengthens the protection and processing of personal data according to principles of fairness, lawfulness, transparency, confidentiality, and respect for data subjects. Data is also handled under Brazil's General Data Protection Law (LGPD – Law No. 13.709/2018).

This website is the data controller for the following personal information collected at the time of contact request from clients, previously authorized for the purpose of executing the requested service:

• Contact information – including name, phone number, and email address.

 

In accordance with Brazilian telehealth regulations, this site does NOT collect or retain any of the following:

• Health-related data;

• Anamnesis or medical history;

• Third-party identification data or therapeutic content;

• Any health information obtained during psychological support, psychotherapy, or any patient-therapist communication in general.

 

Additional data, such as payment information, is processed by third-party payment gateway systems and protected under their security protocols.

 

In line with the ethical code of psychologists and the National Psychology Councils of Italy, Italian-speaking citizens residing in Italy (not part of the Italian-speaking community in Brazil or abroad) cannot access the psychological counseling or psychotherapy services offered on this website. These services fall under the jurisdiction of the professional boards in their respective locations.

Switzerland: This website offers only psychological counseling and mental coaching services in Switzerland. These are not considered psychotherapeutic services under Swiss law. Marcos Boson is officially recognized as a psychologist in Switzerland by PsyKo – Psychologieberufekommission (Federal Office of Public Health – BAG), which confirms the equivalency of his title to a Swiss diploma and authorizes the use of the protected category of "Psychologist" under Articles 3 and 4 of the Federal Law on Psychology Professions (LPsy). As such, the services offered via this website do not include psychotherapeutic treatments in the Swiss context.

The coaching services in Switzerland are considered pathways for personal growth, emotional exploration, and individual resource development and are compliant with non-medical activity regulations.

Personal data collected for contact or coaching management purposes is processed under the Swiss Federal Data Protection Act (nLPD – 2020), ensuring transparency, security, and confidentiality.

European Union (EU): Unless otherwise specified, any reference to the European Union within this website refers to all current EU and EEA member states.

In accordance with the right of free market and choice, citizens residing in the EU or EEA who are not domiciled in Brazil may not access the psychotherapeutic services offered through this site, as those services are regulated by their local health authorities. However, they may access non-clinical psychological support services, such as counseling, mentoring, or coaching, which are explicitly not to be considered psychotherapy.

These services are offered in compliance with EU law, GDPR, and the Brazilian LGPD.

Switzerland (CH): The services provided through this site are offered by Marcos Boson, a psychologist recognized in Switzerland (with an officially homologated title) but not registered as a psychotherapist with the FOPH (Federal Office of Public Health). Therefore:

• These are not psychotherapy services reimbursable under mandatory health insurance (LAMal);

• The services fall within psychological counseling, mental coaching, intercultural support, and personal development;

• The services are private and not reimbursed by LAMal, unless specified by complementary insurance policies.

 

The professional operates in compliance with the Ethical Code of Psychologists, the revised Federal Data Protection Act (nLPD, 2023), and the GDPR where applicable.

By using this site, the User agrees to the following conditions:

​

1. Services Provided Services may include Mental Coaching, psychological counseling, or online psychological support sessions using encrypted technology provided by third parties.

• For users domiciled in Switzerland, services are provided by a psychologist recognized by PsyKo (under LPsy) and may be partially reimbursed by complementary insurance policies (refer to your policy).

• For users in the EU or other countries without automatic title recognition, only Psychological Assistance or Mental Coaching services are available. These are intended for personal development and non-therapeutic support.

• For users domiciled in Brazil, services comply with CFP regulations and Law No. 13.989/2020 on psychological teleconsultation.

 

2. Informed Consent Users must provide Informed Consent via PDF before the first session, depending on the service requested (coaching or counseling). This can be signed digitally or confirmed by email. The Professional must store this securely and not disclose it to third parties, as required by the GDPR and Swiss nLPD (2023).

 

3. Session Modifications or Cancellations: The User must notify the Professional at least 24 hours in advance to cancel or reschedule a session. Sessions canceled within 24 hours’ notice are subject to full payment unless exceptional circumstances apply.

 

4. Payment of Services: Users must pay in advance using the available payment methods (IBAN bank transfer, TWINT, PayPal, or secure link). The paid amount must be confirmed by Users via email to the Professional. For packages or discounted offers, payment must be made in full before the first session.

 

5. In Case of Discontinuation: Users may terminate the service at any time, provided a written notification to the Professional. Refunds will be evaluated case by case. The website is not operational on weekends or official Swiss holidays unless otherwise communicated.

 

6. Service Modifications or Suspension: The Professional reserves the right to modify or suspend the service at any time without notice if professional, legal, or ethical reasons arise. Unused prepaid sessions may be refunded.

 

7. Emergency Situations: The services offered are not suitable for psychiatric emergencies or suicidal risk. In such cases, Users should immediately contact local health services or emergency numbers (e.g., 144 in Switzerland, 112 in the EU, 192 in Brazil).

 

8. Violations of Terms and Conditions: In case of violation, the Professional may suspend or terminate services without refund. Legal action may be taken for any resulting damages.

 

9. Partial Invalidity: If any clause of these Terms, Privacy Policy, or Cookie Policy is declared invalid, all remaining clauses will still keep in full effect.

 

10. Jurisdiction For Disputes: Users domiciled in Switzerland, the EU, or other countries, jurisdiction lies with the court of Basel-Landschaft (CH). For Users domiciled in Brazil, jurisdiction lies with the court of Belo Horizonte (MG).
 

Definitions and Legal References

 

Personal Data ("Data"): Any information that directly or indirectly identifies or can identify an individual, including through association with other data such as an ID number.

User: The individual using services provided by the Professional represented on this site.

 

Professional: the psychologist, psychotherapist, or mental coach with legally recognized credentials. The Professional establishes a therapeutic or mentoring relationship with the User and is responsible for safeguarding their Personal Data.

 

Data Processor ("Processor"): Any person or entity that processes Personal Data on behalf of the Data Controller, as described in this policy.

 

Data Controller ("Controller"): The individual or entity that determines the purposes and means of processing Personal Data. Unless otherwise stated, the Controller is the owner of this website.

 

This Website: The software tool (www.marcosboson.com), hosted on WIX, through which User data is collected and processed.

 

Service: The service offered through this website, as described in these Terms and Conditions.

 

Cookies: This website does not use proprietary cookies. However, small amounts of data may be stored by the WIX platform for statistical purposes.
